Warranty Policy

We guarantee that all the items we sell will meet your personal satisfaction and we warrant them free from manufacturing defects in materials and workmanship. If you notice that one of our products seems to have a defect, please email us within 24 hours of receipt. If for any reason you decide you want to return your purchase and the item HAS NOT been opened, you may return it to us within 30 days. An RMA number may be requested by emailing us at: info@forefrontinnovators.com. You will be provided with an RMA number and instructions for sending the product(s) back to us. To obtain the RMA number, please provide us with the invoice number and reason for return. Once you receive a return authorization, you may return unused items, within 30 days for a refund. All items must be returned in original packaging and in resaleable condition. Forefront Innovators will not accept returned merchandise without a return authorization (RMA) number. Please write this number in a conspicuous place on the outside of the package. Original shipping and handling charges are non-refundable (if applicable). Please allow 7-10 days for credit for returned item(s). Shipping for returned merchandise will be paid by Forefront Innovators, at their discretion.

Orders and Pricing

Merchandise, prices and specifications are subject to change to change without notice. Descriptive, typographic or photographic errors are subject to correction at any time without notice. Any price changes effective after you have placed an order will not change the prices on your order. Prices do not include applicable taxes for all domestic/international orders and shipping costs for international orders. Shipping is free for all domestic orders. Delivery dates are estimates only and any delays in shipment/damaged items/lost items/duties or fees are not the responsibility of Forefront Innovators.

Forefront Innovators will not be held liable for any loss that may occur and cause a delay or failure in the order process/obligations resulting from events that are beyond its reasonable control. Such events may include: Acts of God, war/civil unrest, natural disaster(s), acts or regulations of any government/national authority, pandemic(s), strikes, labor disputes and lack of supplies or laborers.

Export Control Classification

This pneumatic tourniquet falls under the U.S. Bureau of Industry and Security/U.S. Department of Commerce export classification EAR99.

Liability

For any claim arising due to injury, loss, damage or death related to product to the use or sale of products, buyer agrees to hold Forefront Innovators harmless from any and all losses (any liabilities, expenses, losses, claim or judgement, including any and all attorney’s fees), by reason of or irising out of any suit or claim, against any of Forefront Innovator’s owners, employees, officers, suppliers and/or their employees.

To the maximum extent permitted by applicable law, Forefront Innovators will not be liable for misuse, misrepresentation, using the device(s) outside of its intended use, using any part of the device outside of what it is designed for, or reselling or gifting the device to another (or not letting device to be accessible to kids or persons that are unable to use the device correctly).

Certain devices are sold as non-prescription devices and are intended to be used by trained personnel only. If the instructions set forth are not followed, additional risks may arise. Buyer warrants it complies with these restrictions discussed within the website.

Buyer’s sole remedies are set forth in the warranty.

For any third-party components, Forefront Innovators will pass through to Buyer any warranties provided by the third party, if any. Such components are sold by Forefront Innovators “as is” and Forefront Innovators disclaims all express and implied warranties. For component manufactured to Forefront Innovator’s specification, Forefront Innovators warrants such components are free from manufacturing defects. Forefront Innovators disclaims all other express or implied warranties.Forefront Innovators expressly disclaims liability for the manner in which Forefront Innovator’s products are used. If there is a breach of warranty, it can be remedied in one of two ways: 1) Repair or replace defective product or 2) refund the purchase price. Forefront Innovators will be responsible for choosing which remedy will be deemed necessary.

Indemnification

Buyer agrees to defend, indemnify, and hold harmless Forefront Innovators from and against any losses (any liabilities, expenses, losses, claim or judgement, including any and all attorney’s fees), by reason of or irising out of any suit or claim against Forefront Innovators relating to:

1-Buyer shows negligence, gross negligence or willful misconduct,

2-buyer violates any applicable law or governmental regulations,

3-any breach of Buyer’s obligations under these terms,

4-misuse of Forefront Innovator’s website or

5-No RX Only, but you, the buyer/user, hold harmless the seller, Forefront Innovators, if you have misrepresented yourself as someone who has been trained on how to use the MRTD 16 or a medical professional to purchase and use this device. Any misuse, misrepresentation, using the device(s) outside of its intended use, using any part of the device outside of what it is designed for, or reselling or gifting the device to another (or not letting device to be accessible to kids or persons that are unable to use the device correctly).

Intellectual Property

Buyer has no right, title or interest in the trade names, trademarks, trade dress, copyrights, patents, domain names, product names or any other intellectual property rights of Forefront Innovators or its suppliers. All materials on Forefront Innovator’s website are subject to the ownership rights of Forefront Innovator’s suppliers. Buyer shall in no way copy or use any intellectual property rights of Forefront Innovators or its suppliers without Forefront Innovator’s express, written permission.
